Terms of Service

1. Introduction

Welcome to West Michigan Home Pros (“West Michigan Home Pros,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the West Michigan Home Pros platform, including our website, mobile application, and any related services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

The Platform is operated in and primarily serves Southwest Michigan. These Terms are governed by the laws of the State of Michigan.

2. Description of Service

West Michigan Home Pros is a venue that connects homeowners seeking residential services with independent service professionals (“Pros”) who offer those services. Homeowners may post job requests, browse Pro profiles, and communicate with Pros through the Platform. Pros may create profiles, browse job requests, and communicate with homeowners.

West Michigan Home Pros is a venue only. We are not a contractor, service provider, employer, or agent of any Pro. We do not perform, employ, or supervise any services offered by Pros.

3. No Verification; No Endorsement

West Michigan Home Pros provides an online venue connecting homeowners and independent service professionals. West Michigan Home Pros does not verify, screen, vet, or confirm any Pro's identity, license, insurance, bonding, qualifications, background, or the accuracy of any information in a Pro's profile.

Listing on West Michigan Home Pros is not an endorsement, recommendation, or guarantee of any Pro. Any representation or implication to the contrary in marketing, copy, or user interface is unintentional and superseded by these Terms. The display of a Pro's profile, rating, or other information on the Platform does not constitute a representation by West Michigan Home Pros Pro regarding that Pro's quality, reliability, licensure, or fitness for any particular purpose.

4. Self-Reported Information

All Pro credentials, license information, insurance information, qualifications, statements, descriptions, photographs, and other content appearing on Pro profiles (“Pro-Provided Content”) are provided by the Pros themselves. Pros are solely responsible for the accuracy and currency of their Pro-Provided Content.

West Michigan Home Pros is not responsible for any inaccurate, outdated, misleading, or false information posted by a Pro. West Michigan Home Pros has no obligation to review, verify, or correct Pro-Provided Content, though we reserve the right to remove content that violates these Terms or applicable law.

5. Independent Parties

Pros are independent businesses, not employees, agents, partners, joint venturers, or representatives of West Michigan Home Pros. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between West Michigan Home Pros and any Pro.

West Michigan Home Pros is not a party to, and assumes no responsibility for, any contract, transaction, agreement, or dispute between a homeowner and a Pro. Any agreement between a homeowner and a Pro is solely between those parties, and West Michigan Home Pros has no obligation to mediate, arbitrate, or resolve disputes between them.

6. Assumption of Risk; “As Is”

The Platform is provided “as is” and “as available,” without warranties of any kind, either express or implied, including without limitation implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Homeowners assume all risk associated with selecting, hiring, communicating with, and working with any Pro, including without limitation the responsibility to verify a Pro's licensing, insurance, bonding, references, and qualifications independently. We encourage homeowners to verify Pro license status directly with the State of Michigan Department of Licensing and Regulatory Affairs (LARA) at michigan.gov/lara and to request a current Certificate of Insurance from any Pro before work begins.

7. Pro Representations and Indemnification

Each Pro represents and warrants that:

  • All information in the Pro's profile is true, accurate, and current;
  • The Pro holds all licenses, insurance, bonds, and permits required by law for the work the Pro performs and will maintain them at all times while listed on the Platform;
  • The Pro will comply with all applicable federal, state, and local laws, regulations, and ordinances, including without limitation Michigan's residential builder and maintenance & alteration contractor licensing requirements under Article 24 of Public Act 299 of 1980, as administered by LARA; and
  • The Pro will carry and maintain general liability insurance and, where applicable, workers' compensation insurance as required by law.

Each Pro agrees to indemnify, defend, and hold harmless West Michigan Home Pros and its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • The Pro's representations, profile information, or Pro-Provided Content;
  • The Pro's services, work, or conduct;
  • The Pro's failure to maintain required licenses, insurance, bonds, or permits;
  • Any injury, damage, or loss caused by the Pro's acts or omissions; or
  • Any dispute between the Pro and a homeowner.

8. Limitation of Liability

To the fullest extent permitted by applicable law, West Michigan Home Pros and its owners, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation damages for personal injury, property damage, lost profits, or loss of business, arising out of or related to:

  • A homeowner's reliance on any Pro-Provided Content;
  • Any interaction, communication, agreement, transaction, or dispute between a homeowner and a Pro;
  • Any services performed or not performed by a Pro;
  • The conduct, acts, or omissions of any Pro or homeowner; or
  • The Platform's operation, unavailability, or any errors therein.

In no event shall West Michigan Home Pros's total aggregate liability to any user for all claims arising out of or relating to the Platform or these Terms exceed the greater of (a) the fees paid by that user to West Michigan Home Pros during the twelve (12) months preceding the claim, or (b) one hundred dollars ($100.00).

9. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update your information to keep it accurate, current, and complete. West Michigan Home Pros reserves the right to suspend or terminate accounts that provide false or misleading information.

10. Prohibited Conduct

Users may not use the Platform to:

  • Misrepresent licenses, insurance, qualifications, identity, or affiliations;
  • Harass, threaten, or defraud other users;
  • Post false, misleading, or defamatory content;
  • Circumvent the Platform's messaging or payment systems;
  • Violate any applicable law or regulation; or
  • Interfere with the operation of the Platform.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting a notice on the Platform or by email. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
